Finance Minister Arun Jaitley attacks Congress over impeachment attempts

Finance Minister Arun Jaitley launched a scathing attack against the Congress after the petition filed by its MPs against Rajya Sabha Chairperson Venkaiah Naidu’s decision to rejection the impeachment notice versus Chief Justice of India Deepak Misra was dismissed as withdrawn by the Supreme Court.

Two Congress MPs on Monday withdrew their plea in the Supreme Court challenging rejection of the impeachment notice against Chief Justice of India Dipak Misra by Rajya Sabha Chairman M Venkaiah Naidu. 

After a 45-minute hearing, a five-judge bench headed by Justice A K Sikri declared the petition dismissed as withdrawn.

Attorney General K K Venugopal contented that only 2 MPs of Congress have approached the apex court and six other parties, which had given a notice for impeachment, did not move the top court. 

Earlier during the hearing, senior counsel Sibal had raised questions on the setting up of the constitution bench, including who passed the order for setting up the five-judge bench to hear the matter.

Union Finance minister and senior BJP leader Arun Jaitley has come down heavily against the congress party for the the writ petition challenging the order of the Chairman, Rajya Sabha in case of notice for impeachment of the chief justice of India as unarguable. In a facebook post titled “The Impeachment Fiasco – Another Example of Congress Adopting a Fringe Position” Jaitley has questioned the wisdom and the logic behind the entire move by the congress adding that – the impeachment motion against the Chief Justice of India was wholly misconceived, poorly drafted and lacked in substance. He further added that if the motion for impeachment was unsustainable, the writ petition challenging the order of the Chairman, Rajya Sabha, was unarguable.

Jaitley added that the rejection of motion by chairman was a well reasoned order and the rulings of the Chair on whether to admit a motion or otherwise, are not subject to judicial review. He described the writ petition as an effort by congress to fish in troubled waters.

Jaitley further laments that the congress is actually deviating from the mainstream and taking such a fringe position?

RS Chairman M Venkaiah Naidu had on April 23 rejected the impeachment notice against the CJI given by seven opposition parties led by the Congress on five grounds of “misbehaviour”.

This was the first time that an impeachment notice was filed against a sitting CJI.
